 EcoExpert ECOEXPERT AIRBNB HOST GUARANTEE TERMS AND CONDITIONS

EcoExpert airbnb (hereafter referred to as “EcoExpert airbnb”, “we”, “us”, or “our”) provides an online platform that connects hosts (hereafter referred to as “Host”, “you”, or “your”) who create listings for accommodations that are made available for booking by Guests (defined below) seeking to book such accommodations (collectively, the “Services”), which Services are accessible at http://www.ecoexpert.gr/EcoExpert airbnb and any other platform through which EcoExpert airbnb makes the Services available (collectively, the “Site”) and via applications for mobile devices (collectively, the “Application”). EcoExpert airbnb refers to EcoExpert airbnb Inc. if you reside in the USA, and to EcoExpert airbnb Ireland if you reside outside of the USA. For purposes of these Host Guarantee Terms and Conditions, “EcoExpert airbnb”, “we”, “us” or “our” shall also include, as applicable, EcoExpert airbnb’s insurer under the EcoExpert airbnb Insurance Policy or EcoExpert airbnb’s insurance adjuster.

YOU ACKNOWLEDGE AND AGREE THAT, BY POSTING A LISTING OR OTHERWISE USING THE SITE, APPLICATION OR SERVICES AS A HOST, YOU ARE INDICATING THAT YOU HAVE READ, AND THAT YOU UNDERSTAND AND AGREE TO BE BOUND BY, THESE ECOEXPERT AIRBNB HOST GUARANTEE TERMS. If you accept or agree to these EcoExpert airbnb Host Guarantee Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these EcoExpert airbnb Host Guarantee Terms and, in such event, “you” and “your” will refer and apply to that company or other legal entity.

YOU MUST COMPLY WITH ALL OF THE REQUIREMENTS AND CONDITIONS IN THE ECOEXPERT AIRBNB HOST GUARANTEE IN ORDER TO BE ELIGIBLE TO RECEIVE ANY PAYMENTS FOR COVERED LOSSES (DEFINED BELOW). YOUR FAILURE TO FULLY COMPLY WILL PREVENT YOUR RECOVERY FOR ANY COVERED LOSSES.

PLEASE CAREFULLY REVIEW THE DEFINITIONS OF “COVERED ACCOMMODATION,” “COVERED LOSSES,” “COVERED PROPERTY” AND “EXCLUDED PROPERTY” BELOW SO THAT YOU MAY IDENTIFY AND PROTECT PROPERTY NOT COVERED BY THE ECOEXPERT AIRBNB HOST GUARANTEE.

You acknowledge and agree to use your best efforts to communicate with the Responsible Guest (defined below) as soon as possible after you discover any physical loss or damage to your Covered Property. You must notify the Responsible Guest about your complaint and attempt to resolve the loss or damage with the Responsible Guest. If you and the Responsible Guest are unable to come to a resolution within seven (7) days after first contacting the Responsible Guest, you should complete and file an EcoExpert airbnb Host Guarantee Payment Request Form with EcoExpert airbnb as further described in Section V below.

You acknowledge and agree that any amount of Covered Losses payable to you under the EcoExpert airbnb Host Guarantee will be reduced by the amounts you have already collected for the same Covered Losses from a source other than the EcoExpert airbnb Host Guarantee, including without limitation: (i) amounts received under an insurance policy, guarantee or indemnity; (ii) a security deposit; or (iii) payment directly by the Responsible Guest or an Invitee (defined below), or other party or an insurer or guarantor of such party.

Except as permitted by law, these EcoExpert airbnb Host Guarantee Terms do not affect your statutory rights. If you would like a written copy of the EcoExpert airbnb Host Guarantee Terms, please contact EcoExpert airbnb at info@ecoexpert.gr .

EcoExpert airbnb agrees to pay you, as a Host, to repair or replace your Covered Property damaged or destroyed as a result of a Covered Loss, subject to the limitations, exclusions and conditions in the EcoExpert airbnb Host Guarantee.

  1. Key Defined Terms

The following capitalized terms shall have the following meanings:

Actual Cash Value” means the amount it would cost to repair or replace damaged or destroyed Covered Property as a result of a Covered Loss, measured on the date of occurrence of such Covered Loss, with material of like kind and quality, with proper deduction for obsolescence and physical depreciation.

EcoExpert airbnb Insurance Policy” means an insurance policy issued by an insurer to EcoExpert airbnb pursuant to which EcoExpert airbnb is insured against losses arising under the EcoExpert airbnb Host Guarantee.

Booking Income Loss” is the loss of booking income from the booked portion of a Covered Accommodation (according to bona fide EcoExpert airbnb confirmed bookings, contracts or agreements in force prior to the established time of loss) by you, as a Host, resulting from a Covered Loss. Booking Income Loss does not include non-continuing charges and expenses or any loss of booking income during any period in which the Covered Accommodation would not have been tenantable for any reason other than a Covered Loss. The Booking Income Loss will be measured by EcoExpert airbnb’s insurer starting from the time of occurrence of the Covered Loss and ending when the Covered Accommodation can be made ready for habitation under the same or equivalent physical and operating conditions that existed prior to the damage.

Covered Accommodation” means an accommodation located in the Territory that can be used as a residence and that is (i) owned or legally controlled by you as a Host during the period of the Responsible Guest’s stay at such accommodation and (ii) listed by you on the Site and booked by such Responsible Guest in compliance with the EcoExpert airbnb Terms of Service. A vehicle (including, but not limited to, automobiles, scooters, vespas, and motorcycles) or a watercraft (including, but not limited to, boats, yachts, jet skis and similar craft) booked through the Services constitutes a “Covered Accommodation” only to the extent it is stationary and used solely for lodging purposes.

Covered Losses” means and is limited to direct physical loss or physical damage incurred by a Host to Covered Property of such Host located at a Covered Accommodation caused by the Responsible Guest or an Invitee of the Responsible Guest while staying at such Covered Accommodation booked by such Responsible Guest through the Services. Covered Losses do not include any losses or damage described under Excluded Losses below.

Covered Property” means and is limited to the following property located at a Covered Accommodation, or within 1,000 feet thereof, to the extent of your interest in such property, unless such property constitutes Excluded Property (as defined below):

  • A. Real property, including new buildings and additions under construction located at the site of such Covered Accommodation, in which you have an insurable interest.
  • B. Personal property that is:
    1. owned by you, including your interest as a tenant in improvements and betterments.
    2. not owned by you, but is in your custody and for which you are under obligation to keep the personal property insured for physical loss or damage.
    3. not owned by you, but is in your custody and for which you have legal liability for physical loss or damage to the property.

Excluded Losses” has the meaning set forth in Section III below.

Excluded Property” means any of the following:

  1. Currency, money, precious metal in bullion form, notes or securities.
  2. Land, water or any other substance in or on land; except this exclusion does not apply to (i) land improvements consisting of landscape gardening, roadways and pavements, but not including any fill or land beneath such property, or (ii) water that is contained within any enclosed tank, piping system or any other processing equipment.
  3. Animals, including, but not limited to, livestock and pets.
  4. Standing timber; growing crops.
  5. Watercraft (including, but not limited to, boats, yachts, jet skis, and similar craft), aircraft, spacecraft, and satellites. This watercraft exclusion does not apply with respect to any watercraft which is a Covered Accommodation. However, this exclusion does apply to vessels that, at the time of the loss, are in transit, or are moving greater than 10 feet from their usual fixed location and moving faster than one mile per hour.
  6. Vehicles (including, but not limited to, automobiles, scooters, vespas, and motorcycles). This exclusion does not apply with respect to any vehicle that is a Covered Accommodation. However, this exclusion does apply to vehicles that, at the time of the loss, are in transit, or are moving greater than 10 feet from their usual fixed location and moving faster than one mile per hour.
  7. Underground mines or mine shafts or any property within such mine or shaft.
  8. Dams, dikes and levees.
  9. Property in transit, except as otherwise provided by these EcoExpert airbnb Host Guarantee Terms.
  10. Transmission and distribution lines beyond 1,000 feet of the Covered Accommodation.
  11. Any damage to any property that is not in, at, or on a Covered Accommodation.
  12. Real property owned by a party other than you and that you do not control.

Fine Arts” means paintings; etchings; printed photos; pictures; tapestries; rare or art glass; art glass windows, valuable rugs; statuary; sculptures; antique furniture; antique jewelry; bric-a-brac; porcelains; and similar property of rarity, historical value, or artistic merit. “Fine Arts” does not include automobiles, coins, stamps, other collectibles, collections, furs, jewelry, precious stones, precious metals, watercraft, aircraft, money, or securities.

Guest” means a Member who has completed EcoExpert airbnb’s account registration process, has agreed to the EcoExpert airbnb Terms of Service, and who books and stays on, at, or in a Covered Accommodation for the period of the Listing.

Host” means a Member who has completed EcoExpert airbnb’s account registration process, has agreed to the EcoExpert airbnb Terms of Service, and who lists his/her Covered Accommodation(s) on the Site or Application.

Invitee” means a person invited to be present at a Covered Accommodation by a Responsible Guest.

Limit” means one million US dollars (US $1,000,000), or its equivalent in the currency where the Covered Accommodation is located at the exchange rate applicable on the date of payment by EcoExpert airbnb under these EcoExpert airbnb Host Guarantee Terms.

Listing” means an Accommodation that is listed by a Host as available for booking via the Site or Application.

Member” means a person who completes EcoExpert airbnb’s account registration process, including, but not limited to Hosts and Guests, as described under “Account Registration” in the EcoExpert airbnb Terms of Service.

Ordinary Wear and Tear” means the deterioration in condition of property that occurs under normal use and conditions.

Responsible Guest” means the Guest who booked your Covered Accommodation for the period during which you incurred the Covered Losses for which you request payment under these EcoExpert airbnb Host Guarantee Terms.

Territory” means the countries for which the EcoExpert airbnb Host Guarantee is available, as announced by EcoExpert airbnb from time to time.

III. Limitations and Exclusions

The EcoExpert airbnb Host Guarantee pays Covered Losses only and does not pay for any of the following (“Excluded Losses”):

  1. any losses caused by a Guest or Invitee after the expiration of the booking period shown in the applicable Listing.
  2. losses or damages for Covered Property, which arise out of any one booking of a Covered Accommodation by a Responsible Guest, in excess of the Limit.
  3. in the case of Fine Arts, losses or damages if the Fine Arts cannot be replaced with other of like kind and quality and any loss or damage from any repairing, restoration or retouching process.
  4. any losses, damages, cost or expense of whatsoever nature, directly or indirectly, caused by, relating to or resulting from any of the following:
    • (i) Excluded Property;
    • (ii) acts of nature, including, but not limited to, earthquakes and weather related events such as hurricanes and tornadoes;
    • (iii) excessive use of electricity, gas, fuel, water or other utilities provided for the Covered Accommodation;
    • (iv) indirect or remote causes;
    • (v) interruption of business, loss of market and/or loss of use, except that the EcoExpert airbnb Host Guarantee does cover Booking Income Loss;
    • (vi) loss, damage, or deterioration arising from any delay;
    • (vii) mysterious disappearance, loss, or shortage disclosed on taking inventory, or any unexplained loss of inventory;
    • (viii) enforcement of any law or ordinance (i) regulating the construction, repair, replacement, use or removal of any property, including removal of debris, or (ii) requiring the demolition of any property, including the cost of removing its debris;
    • (ix) animals, including injuries to animals, veterinary care, boarding, medications, and all other services associated with animals; or
    • (x) identity theft or identity fraud.
  5. any losses, damages, cost or expense of whatsoever nature, directly or indirectly, caused by or resulting from any of the following, regardless of any other cause or event contributing thereto:
    • (i) any hostile act or act of war, terrorism, insurrection or rebellion;
    • (ii) actual or threatened malicious use of poisonous biological or chemical materials;
    • (iii) nuclear reaction or radiation or radioactive contamination;
    • (iv) seizure or destruction under quarantine or custom regulation, or confiscation by order of any governmental or public authority;
    • (v) contraband, or illegal transportation or trade;
    • (vi) any dishonest act, including but not limited to theft, committed by you or any persons or entities retained by you to do anything in connection with Covered Property, unless such persons or entities are a Responsible Guest or Invitee and such act is done without your knowledge; or
    • (vii) lack of electricity, fuel, water, gas, steam, refrigerant, sewerage, telephone or internet services due to external factors.
  6. the following conditions:
    • (i) faulty workmanship, material, construction or design from any cause;
    • (ii) deterioration, depletion, rust, corrosion or erosion, inherent vice or latent defect;
    • (iii) Ordinary Wear and Tear;
    • (iv) settling, cracking, shrinking, bulging, or expansion of foundations, floors, pavements, walls, ceilings or roofs;
    • (v) changes of temperature or relative humidity; or
    • (vi) damage caused by insects, animals or vermin (including pets);

provided, that any physical damage resulting from any of the conditions listed above will be covered by the EcoExpert airbnb Host Guarantee if not otherwise excluded under the EcoExpert airbnb Host Guarantee.

  1. any losses, damages, claims, costs, expenses or other sums directly or indirectly arising out of or relating to mold, mildew, fungus, spores or other microorganism of any type, nature, or description, including but not limited to any substance whose presence poses an actual or potential threat to human health. This exclusion applies even if there is (i) any physical loss or damage to Covered Property; (ii) any peril or cause covered hereunder, whether or not contributing concurrently or in any sequence; (iii) any loss of use, occupancy, or functionality; or (iv) any action required, including but not limited to, repair, replacement, removal, cleanup, abatement, disposal, relocation, or steps taken to address medical or legal concerns.
  2. any fees that may be charged to a Guest by a Host for additional individuals invited to, or otherwise provided access to, the Covered Accommodation who are not included in the Guest’s booking of such Covered Accommodation.
  1. Conditions to the EcoExpert airbnb Host Guarantee

IN ORDER TO BE ELIGIBLE TO OBTAIN PAYMENT UNDER THESE ECOEXPERT AIRBNB HOST GUARANTEE TERMS, YOU MUST FULLY COMPLY WITH EACH OF THE FOLLOWING CONDITIONS. YOUR FAILURE TO FULLY COMPLY WILL PREVENT YOUR RECOVERY OF ANY COVERED LOSSES. IN ALL CASES, THE ONUS WILL BE UPON YOU TO DEMONSTRATE THAT YOU HAVE COMPLIED WITH THE FOLLOWING CONDITIONS.

You must have incurred Covered Losses.

The Covered Losses for which you seek payment must be covered under the EcoExpert airbnb Insurance Policy and payment to EcoExpert airbnb under such EcoExpert airbnb Insurance Policy, and EcoExpert airbnb in its sole discretion may make its payment of benefits under this EcoExpert airbnb Host Guarantee contingent upon the determination that any Covered Losses are covered under the EcoExpert airbnb Insurance Policy.

You must inspect the applicable Covered Accommodation to determine whether there are any physical losses or damages to any Covered Property and complete and file an EcoExpert airbnb Host Guarantee Payment Request Form with EcoExpert airbnb within the earlier of (i) fourteen (14) days following the date of termination of the Responsible Guest’s booking of the applicable Covered Accommodation or (ii) the date by which the next subsequent booking of the same Covered Accommodation begins.

For all Covered Property which is damaged or destroyed due to a violation of law or criminal act or misdemeanor and for which you are filing an EcoExpert airbnb Host Guarantee Payment Request Form, you must file a police report listing such Covered Property and provide EcoExpert airbnb with a copy of such report, certified by you as true and correct.

You must provide EcoExpert airbnb with proof of ownership of, or legal responsibility for, the Covered Property in the form of receipts, photographs, videos, documents or other customary forms of proof (including, but not limited to, appraisal or valuation forms or notices addressed to you) certified by you as true and correct and reasonably acceptable to EcoExpert airbnb.

You must deliver a signed and sworn proof of loss to us within sixty (60) days after you have incurred the Covered Loss, unless we provide a written extension of such deadline. The proof of loss must state your knowledge and belief as to the following:

  • The time, cause and origin of the Covered Loss, and evidence and proof such loss in the form of receipts, photographs, videos, documents and other verifiable forms of proof.
  • The ownership, leasehold or other interest of you and all other parties in the Covered Property for which Covered Loss is claimed.
  • The Actual Cash Value and replacement value of each item of the Covered Property, as well as the current appraised value in the case of Fine Arts articles, that is the subject of the Covered Loss and the amount of such loss or damage to each item of such Covered Property.
  • All liens, encumbrances, mortgages, guarantees and all other contracts of insurance, whether valid or not, covering the Covered Property that is the subject of the Covered Loss.
  • Any changes in the title, use, occupation, location, possession, or exposures of the Covered Accommodation since the date of the Listing.
  • The identity of and other information known about the Responsible Guest, any Invitee and any other party present at or using the Covered Accommodation where the Covered Property is located for which the Covered Loss is claimed on the date of the Covered Loss, and the purpose for which such Covered Accommodation was being used by such parties on such date and whether or not it then stood on leased ground.
  • The date when you contacted the Responsible Guest to request payment for the loss you are claiming, and the date on which the Responsible Guest declined or failed to pay for the loss.

As part of the signed and sworn proof of loss described above, you must provide EcoExpert airbnb with all information reasonably requested by EcoExpert airbnb to enable EcoExpert airbnb’s insurer to determine the Actual Cash Value with respect to Covered Property, including: the original purchase price of such Covered Property, the date such Covered Property was acquired, the condition of such Covered Property and the estimated cost of repair or replacement of such Covered Property.

You must (i) protect and preserve damaged Covered Property from further loss or damages and (ii) promptly separate the damaged and undamaged Covered Property, put it in the best possible order, and furnish a complete inventory of the lost, destroyed, damaged and undamaged property showing in detail the quantities, costs, Actual Cash Value, and amount of loss claimed.

You must, as often as may be reasonably required, at such reasonable times and places that may be designated by EcoExpert airbnb’s insurer or its respective designees, (i) exhibit all that remains of any damaged Covered Property and sign the written records of examination; (ii) produce for examination all books of accounts, business records, bills, invoices, and vouchers (either originals or certified copies if originals are lost) and (iii) permit extracts and machine copies to be made of the above.

You must permit EcoExpert airbnb’s insurer or its designee(s) to make inspections of Covered Property at all reasonable times. However, the right to make inspections, the making of inspections, and any analysis, advice, or inspection report will not constitute an undertaking by EcoExpert airbnb’s insurer to determine or warrant that damaged Covered Property is safe or healthful. We will have no liability to you or any other person because of any inspection or failure to inspect.

You must cooperate with EcoExpert airbnb, including signing any documents, and timely responding to any reasonable requests by EcoExpert airbnb for additional information or documentation that EcoExpert airbnb or its insurer may require or request to process the applicable EcoExpert airbnb Host Guarantee Payment Request Form.

With respect to Covered Property subject to a loan, mortgage or other security interest, you must notify your lender/mortgagee in writing of any loss that exceeds fifty thousand US dollars (US $50,000), and provide EcoExpert airbnb with a copy of such notice. If the lender/mortgagee notifies you that the lender/mortgagee seeks insurance and/or reimbursement proceeds for the loss, you must notify EcoExpert airbnb in writing of the lender/mortgagee’s request and transmit a written copy of said request to EcoExpert airbnb, and provide all other information to enable EcoExpert airbnb to communicate directly with the lender. If such loss is determined to be a Covered Loss, we will pay the loss benefit(s) to the lender up to the value of the mortgage (subject to the exclusions, limitations and conditions herein), and we will not pay you unless and until your monetary obligation to the lender/mortgagee has been satisfied. This condition shall apply to the extent of applicable law in your jurisdiction.

You will have full rights to the possession and control of damaged Covered Property if proper testing is done to show which property is physically damaged. You, using reasonable judgment, will decide if the physically damaged Covered Property can be reprocessed or sold. If you determine that the Covered Property is unfit for reprocessing or sale, the property will not be sold or disposed of except by you or with your consent. Proceeds from the sale or other disposition of such Covered Property will go to (i) EcoExpert airbnb’s insurer at the time of the Covered Loss settlement, or (ii) you if such sale or disposition proceeds are received prior to Covered Loss settlement and such proceeds will reduce the amount of the Covered Loss payable to you.

  1. Disposition of Host Payment Requests

EcoExpert airbnb Host Guarantee Payment Request Form

EcoExpert airbnb will complete its processing of any EcoExpert airbnb Host Guarantee Payment Request Form that you file within a reasonable period following the date you have (a) completed and filed an EcoExpert airbnb Host Guarantee Payment Request Form, and (b) provided EcoExpert airbnb with all information and materials that you are required to provide to comply with the conditions set forth in “Conditions to the EcoExpert airbnb Host Guarantee” above. In any event, we will use commercially reasonable efforts to complete processing of your EcoExpert airbnb Host Guarantee Payment Request Form within three (3) months after our receipt of such documents and information. If you receive an Approved Payment Request (as defined below), then as a condition to payment to you under the EcoExpert airbnb Host Guarantee, you will be required to execute and deliver to EcoExpert airbnb the “EcoExpert airbnb Host Guarantee Approved Payment Request Agreement”, which includes your agreement:

  1. to assign to EcoExpert airbnb or its insurer any rights and remedies you may have to recover amounts paid to you with respect to an Approved Payment Request (defined below) from the Responsible Guest or from an Invitee or from any other party that is financially responsible for the Approved Payment Request;
  2. to reasonably cooperate with us, including, at our request, appearing as a witness in any court, arbitration or like proceeding, if we seek to recover the amount paid to you with respect to an Approved Payment Request from the Responsible Guest or from an Invitee or from any other party;
  3. to release and hold harmless EcoExpert airbnb and its insurer and all officers, directors, employees, contractors and agents of EcoExpert airbnb from any further liability or obligations with respect to the facts and circumstances of the matters and incident set forth in the EcoExpert airbnb Host Guarantee Payment Request Form;
  4. to treat as “confidential information” the contents and existence of such EcoExpert airbnb Host Guarantee Payment Request Form and Approved Payment Request Payment Agreement; and
  5. to refund to us any amounts that are erroneously paid to you with respect to an Approved Payment Request, such determination by us to be based upon factors including, but not limited to, documentation in our possession, your actions, and police reports, if applicable.

The duration of the processing period of any EcoExpert airbnb Host Guarantee Payment Request Form that you file will depend on factors that include, but are not limited to: (i) the amount of payment that you are requesting for the Covered Loss; (ii) the location of the Covered Accommodation; (iii) the nature of the Covered Property and the nature of the Covered Losses; (iv) the completeness and type of documentation and information that you provide EcoExpert airbnb regarding the Covered Losses; and (v) the number of EcoExpert airbnb Host Guarantee Payment Request Forms that are currently being processed for other Hosts.

Approved Payment Request

If you have filed an EcoExpert airbnb Host Guarantee Payment Request Form and such a payment request is approved in whole or in part for a Covered Loss (any such approved payment request, an “Approved Payment Request”), you will be paid the amount of the Covered Loss as calculated by EcoExpert airbnb’s insurer. The process for such calculation of Covered Losses is described under “Determination of the Amount of the Covered Loss” below. You will be notified by EcoExpert airbnb and, as a condition of payment hereunder, you will be required to deliver to EcoExpert airbnb an executed Approved Payment Request Agreement. EcoExpert airbnb may use third party service providers to assist in the processing of the EcoExpert airbnb Host Guarantee Payment Request Forms and EcoExpert airbnb’s insurer may use third party service providers to assist in the investigation and adjustment of payment requests relating thereto.

For an Approved Payment Request that involves Covered Losses for Covered Property that is owned by a party other than you, we reserve the right, in our sole discretion, to pay all or a portion of the amount covered in such Approved Payment Request either to you or directly to the owner of such Covered Property. If an EcoExpert airbnb Host Guarantee payment for all or a portion of such amount is made directly to the owner of such Covered Property, then you agree that such payment will be treated for purpose of the Approved Payment Request as being paid to you directly, and that you will be solely responsible for collecting from the owner of such Covered Property any portion of such payment to which you believe you are legally entitled. For clarity, your indemnification obligations set forth below under the paragraph entitled “Indemnification” will apply to claims arising from any payments made pursuant to the EcoExpert airbnb Host Guarantee, including without limitation any payments made directly to the owner of any Covered Property.

Determination of the Amount of the Covered Loss

The amount of Covered Losses will be computed as of the date of loss, at the location of the loss, and for not more than your interest, subject to the following:

  1. On exposed films, records, manuscripts, and drawings, the value blank plus the cost of copying information from back-up or from originals of a previous generation. Costs of research, engineering, or restoring or recreating lost information will not be paid.
  2. On Fine Arts articles, the lesser of (i) the reasonable and necessary cost to repair or restore such property to the physical condition that existed on the date of loss; (ii) the cost to replace the article; and (iii) the current appraised value. If the Fine Arts article is part of a pair or set, you will not be paid (1) for the cost of replacing any undamaged or remaining items that form part of such pair or set, (2) more than the proportion that the loss or damaged item bears to the insured value of such pair or set, or (3) the cost of replacing or repairing any undamaged parts of the Fine Arts articles which form part of a pair, set or suite or part of a common design or function when the loss or damage is restricted to a clearly identifiable area or to a specific part.
  3. For all Covered Property (other than that described in paragraphs A and B above), the loss amount will not exceed the lesser of: (i) the cost to repair such damaged Covered Property; (ii) the cost to rebuild or replace such Covered Property on the same site with new materials of like size, kind, and quality; (iii) the cost to rebuild, repair, or replace on the same or another site, but not to exceed the size and operating capacity that existed on the date of the Covered Loss; (iv) the cost to replace unrepairable electrical or mechanical equipment, including computer equipment, with equipment that is the most functionally equivalent to that damaged or destroyed, even if such equipment has technological advantages and/or represents an improvement in function and/or forms part of a program of system enhancement; or (v) the Actual Cash Value if such property is not repaired, replaced, or rebuilt on the same or another site within two years from the date of loss.
  4. Any amount of any Covered Losses payable under the EcoExpert airbnb Host Guarantee will be reduced by the amount already paid to you or for your benefit by a Responsible Guest, Invitee or other source (such as an insurer or other responsible party) for the same Covered Loss.
  5. Covered Losses will be paid in the currency of the United States of America unless, in EcoExpert airbnb’s sole discretion, EcoExpert airbnb elects to pay losses in a different currency. If currency conversions are required, we use a system-wide rate, known as the base exchange rate, for currency conversion using data from one or more third parties, such as OANDA (www.oanda.com).

YOU ARE NOT AN INSURED OR OTHER THIRD PARTY BENEFICIARY UNDER THE ECOEXPERT AIRBNB INSURANCE POLICY. TO THE EXTENT YOU DESIRE ADDITIONAL PROTECTION BEYOND THE COVERAGE AFFORDED BY THE ECOEXPERT AIRBNB HOST GUARANTEE, ECOEXPERT AIRBNB STRONGLY ENCOURAGES YOU TO PURCHASE SEPARATE INSURANCE THAT WILL COVER YOU AND YOUR PROPERTY FOR LOSSES CAUSED BY GUESTS OR GUESTS’ INVITEES IN THE EVENT ECOEXPERT AIRBNB OR ITS INSURER DECLINES COVERAGE FOR CLAIMS UNDER THE ECOEXPERT AIRBNB HOST GUARANTEE OR YOUR LOSS IS NOT OTHERWISE COVERED BY THE ECOEXPERT AIRBNB HOST GUARANTEE.

  1. Acknowledgments and Agreements by the Host

You acknowledge and agree that:

  • The EcoExpert airbnb Host Guarantee is a guarantee of obligations of a Responsible Guest to you and is dependent upon you pursuing any rights and remedies you may have to recover amounts paid by EcoExpert airbnb to you with respect to an Approved Payment Request from the Responsible Guest or from an Invitee or from any other party that is financially responsible for the Approved Payment Request.
  • EcoExpert airbnb provides Hosts with the EcoExpert airbnb Host Guarantee benefits described herein solely for the purpose of promoting use of the Site, Application and Services by building customer loyalty and strengthening customer confidence as to use of the Site, Application and Services.
  • These EcoExpert airbnb Host Guarantee Terms are not intended to constitute an offer to insure, do not constitute insurance or an insurance contract, and do not take the place of insurance obtained or obtainable by you. Furthermore, these EcoExpert airbnb Host Guarantee Terms are not an insurance service agreement as defined in a standard ISO renter’s or homeowner’s insurance policy.
  • The benefits provided under these EcoExpert airbnb Host Guarantee Terms are solely as set forth in the paragraph entitled “EcoExpert airbnb Host Guarantee” above and such benefits are not assignable or transferable by you, including without limitation any transfer or assignment by operation of law or in connection with your divorce or death.
  • EcoExpert airbnb and/or its insurer reserve the right to independently investigate (or to have independently investigated) at our sole discretion and expense, the facts and circumstances of a payment request set forth in any EcoExpert airbnb Host Guarantee Payment Request Form that you file with EcoExpert airbnb, notwithstanding your delivery of all information and materials that you are required to provide EcoExpert airbnb in order to comply with the conditions set forth in the paragraph entitled “Conditions to the EcoExpert airbnb Host Guarantee.”

You acknowledge and agree that if you make a claim under this Host Guarantee, you give EcoExpert airbnb consent to review all communications between you and the allegedly Responsible Guest via the Site or Application.

EcoExpert airbnb reserves the right, at any time, to offset or deduct from the amounts payable or paid by EcoExpert airbnb to you under these EcoExpert airbnb Host Guarantee Terms, any amounts that it may have in its possession, or to subsequently collect, from any other person or entity who is obligated to compensate you for losses or damages.

Because these EcoExpert airbnb Host Guarantee Terms constitute a guarantee agreement, the theory of exoneration applies. Thus, if the Covered Property in question or the risk associated with that Covered Property changes materially, EcoExpert airbnb will be entitled to exoneration with respect to any potential guaranty obligation under these EcoExpert airbnb Host Guarantee Terms.

VII. Modification or Termination of EcoExpert airbnb Host Guarantee Terms

To the extent permissible by applicable law in your jurisdiction, EcoExpert airbnb reserves the right to modify or terminate these EcoExpert airbnb Host Guarantee Terms, at any time, in its sole discretion, and without prior notice. If EcoExpert airbnb terminates these EcoExpert airbnb Host Guarantee Terms in accordance with the foregoing, EcoExpert airbnb will provide you with notice of such termination and EcoExpert airbnb will continue to process all EcoExpert airbnb Host Guarantee Payment Request Forms that you filed prior to the effective date of termination, but your right to file any new EcoExpert airbnb Host Guarantee Payment Request Forms will immediately terminate. If EcoExpert airbnb modifies these EcoExpert airbnb Host Guarantee Terms, we will post the modification on the Site or via the Application or provide you with notice of the modification and EcoExpert airbnb will continue to process all EcoExpert airbnb Host Guarantee Payment Request Forms that you filed prior to the effective date of the modification. By continuing to access or use the Site, Application or Services as a Host after we have posted a modification on the Site or via the Application or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified EcoExpert airbnb Host Guarantee Terms. If the modified EcoExpert airbnb Host Guarantee Terms are not acceptable to you, your only recourse is to cease using the Site, Application and Services as a Host.

In addition to and without limiting EcoExpert airbnb’s rights set forth above in the immediately preceding paragraph, EcoExpert airbnb reserves the right to modify or terminate these EcoExpert airbnb Host Guarantee Terms generally or in any jurisdiction, at any time, in its sole discretion, if: (i) these EcoExpert airbnb Host Guarantee Terms are construed to be an offer to insure or constitute insurance or an insurance contract or insurance service agreement by any governmental or regulatory authority in any jurisdiction; (ii) EcoExpert airbnb is required to obtain a license or permit of any kind to continue to provide these EcoExpert airbnb Host Guarantee Terms in any jurisdiction; or (iii) EcoExpert airbnb determines or a court or arbitrator holds that the provisions of these EcoExpert airbnb Host Guarantee Terms violate applicable law. If EcoExpert airbnb modifies or terminates these EcoExpert airbnb Host Guarantee Terms in accordance with the foregoing, EcoExpert airbnb will process all EcoExpert airbnb Host Guarantee Payment Request Forms that you file prior to or as of the effective date of such modification or termination unless such processing is prohibited by law, regulation, ordinance, order, or decree of any governmental or other authority.

EcoExpert airbnb’s obligations hereunder are contingent upon the availability of insurance proceeds under the EcoExpert airbnb Insurance Policy. The applicable terms and conditions of such policy will be the terms and conditions in effect on the date of the Covered Loss, and not the terms and conditions in effect on the date that the Responsible Guest booked or reserved the applicable Covered Accommodation or the date on which the Host listed the Covered Accommodation. If the policy terms and conditions change in any material respect between the date of the Listing and the first date of the Guest’s stay, EcoExpert airbnb will use its best efforts to notify you of the change(s) pursuant to the procedures set forth above in this section.

VIII. Subrogation

EcoExpert airbnb and/or EcoExpert airbnb’s insurer have the right to subrogate against any person or entity whatsoever who allegedly is responsible for causing the losses or damages in question, even if that person or entity is you. Further, you hereby agree that, with respect to any payments made under the EcoExpert airbnb Host Guarantee by, or on behalf of, EcoExpert airbnb, you will assist in and cooperate fully with EcoExpert airbnb regarding any and all efforts at subrogation.

  1. Disclaimers and Limitations of Liability

IF YOU CHOOSE TO USE THE SITE, APPLICATION, OR SERVICES AS A HOST, YOU DO SO AT YOUR SOLE RISK. THE ECOEXPERT AIRBNB HOST GUARANTEE IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, ECOEXPERT AIRBNB EXPLICITLY DISCLAIMS ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. ECOEXPERT AIRBNB MAKES NO WARRANTY THAT THE ECOEXPERT AIRBNB HOST GUARANTEE WILL MEET YOUR REQUIREMENTS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM ECOEXPERT AIRBNB OR THROUGH THE SITE, APPLICATION, OR SERVICES WILL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.

YOU ACKNOWLEDGE AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ENTIRE RISK ARISING OUT OF YOUR ACCESS TO AND USE OF THE SITE, APPLICATION AND SERVICES, AND YOUR LISTING OF ANY ACCOMMODATIONS VIA THE SITE, APPLICATION AND SERVICES REMAINS WITH YOU. NEITHER ECOEXPERT AIRBNB NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SITE, APPLICATION AND SERVICES WILL BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA OR LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE OR SYSTEM FAILURE, OR FOR ANY DAMAGES FOR (1) PERSONAL OR BODILY INJURY OR EMOTIONAL DISTRESS ARISING OUT OF OR IN CONNECTION WITH THESE ECOEXPERT AIRBNB HOST GUARANTEE TERMS, (2) FROM THE USE OF OR INABILITY TO USE THE SITE, APPLICATION OR SERVICES, (3) FROM ANY COMMUNICATIONS, INTERACTIONS OR MEETINGS WITH OTHER USERS OF THE SITE, APPLICATION, OR SERVICES OR OTHER PERSONS WITH WHOM YOU COMMUNICATE OR INTERACT AS A RESULT OF YOUR USE OF THE SITE, APPLICATION OR SERVICES, OR (4) FROM YOUR LISTING OF ANY ACCOMMODATION VIA THE SITE, APPLICATION AND SERVICES. ECOEXPERT AIRBNB WILL NOT BE LIABLE FOR ANY SUCH DAMAGES DESCRIBED ABOVE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT ECOEXPERT AIRBNB HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, EVEN IF A LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

EXCEPT FOR ECOEXPERT AIRBNB’S OBLIGATION TO PAY AMOUNTS TO YOU PURSUANT TO AN APPROVED PAYMENT REQUEST UNDER THESE ECOEXPERT AIRBNB HOST GUARANTEE TERMS, IN NO EVENT WILL ECOEXPERT AIRBNB’S AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH (A) THESE ECOEXPERT AIRBNB HOST GUARANTEE TERMS; (B) YOUR USE OF OR INABILITY TO USE THE SITE, APPLICATION AND SERVICES INCLUDING, BUT NOT LIMITED TO, POSTING A LISTING, (C) ANY ACCOMMODATION AND (D) YOUR INTERACTIONS WITH ANY OTHER MEMBERS, EXCEED THE AMOUNTS PAID BY ECOEXPERT AIRBNB TO YOU IN THE TWELVE (12) MONTH PERIOD PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), IF NO SUCH PAYMENTS HAVE BEEN MADE, AS APPLICABLE. THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN ECOEXPERT AIRBNB AND YOU. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION FOR CERTAIN LIMITATIONS OF LIABILITY, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

  1. General Provisions

Indemnification

You agree to release, defend, indemnify, and hold EcoExpert airbnb and its affiliates and subsidiaries, and their officers, directors, employees and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with the EcoExpert airbnb Host Guarantee and these EcoExpert airbnb Host Guarantee Terms.

If you rent (rather than own) the accommodation that you list as a Covered Accommodation, the immediately preceding paragraph applies specifically to any dispute between you and the owner of the accommodation. You are fully responsible for securing the lessor’s permission to list the accommodation with EcoExpert airbnb and complying with the scope of any permission granted.

Entire Agreement

These EcoExpert airbnb Host Guarantee Terms constitute the entire and exclusive understanding and agreement between EcoExpert airbnb and you regarding the EcoExpert airbnb Host Guarantee and these EcoExpert airbnb Host Guarantee Terms, and supersede and replace any and all prior oral or written understandings or agreements between EcoExpert airbnb and you regarding the EcoExpert airbnb Host Guarantee.

Assignment

You may not assign or transfer these EcoExpert airbnb Host Guarantee Terms, by operation of law or otherwise, without EcoExpert airbnb’s prior written consent. Any attempt by you to assign or transfer these EcoExpert airbnb Host Guarantee Terms, without such consent, will be null and of no effect. EcoExpert airbnb may assign or transfer these EcoExpert airbnb Host Guarantee Terms, at its sole discretion, without restriction. Subject to the foregoing, these EcoExpert airbnb Host Guarantee Terms will bind and inure to the benefit of the parties, their successors and permitted assigns.

Notices

Any notices or other communications permitted or required hereunder, including those regarding modifications to these EcoExpert airbnb Host Guarantee Terms, will be in writing and given by EcoExpert airbnb (i) via e-mail (in each case to the address that you provide) or (ii) by posting to the Site or via the Application. For notices made by e-mail, the date of receipt will be deemed the date on which such notice is transmitted.

Controlling Law

These EcoExpert airbnb Host Guarantee Terms will be interpreted in accordance with the laws of the State of California and the United States of America, without regard to its conflict-of-law provisions.

Dispute Resolution

General. You and EcoExpert airbnb agree that any dispute, claim or controversy arising out of or relating to these EcoExpert airbnb Host Guarantee Terms or the breach, termination, enforcement, interpretation or validity thereof, or to the use of the Services or use of the Site or Application (collectively, “Disputes”) will be settled by binding arbitration. You acknowledge and agree that you and EcoExpert airbnb are each waiving the right to a trial by jury or to participate as a plaintiff or class member in any purported class action or representative proceeding. Further, unless both you and EcoExpert airbnb otherwise agree in writing, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of any class or representative proceeding. If this specific paragraph is held unenforceable, then the entirety of this “Dispute Resolution” section will be deemed void. Except as provided in the preceding sentence, this “Dispute Resolution” section will survive any termination of these EcoExpert airbnb Host Guarantee Terms.

Arbitration Rules and Governing Law. The arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with the Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes (the “AAA Rules”) then in effect, except as modified by this “Dispute Resolution” section. (The AAA Rules are available at http://www.adr.org/arb_med or by calling the AAA at 1-800-778-7879.) The Federal Arbitration Act will govern the interpretation and enforcement of this Section.

Arbitration Process. A party who desires to initiate arbitration must provide the other party with a written Demand for Arbitration as specified in the AAA Rules. (The AAA provides a form Demand for Arbitration at http://www.adr.org/si.asp?id=3477 and a separate form for California residents at http://www.adr.org/si.asp?id=3485.) The arbitrator will be either a retired judge or an attorney licensed to practice law in the state of California and will be selected by the parties from the AAA’s roster of consumer dispute arbitrators. If the parties are unable to agree upon an arbitrator within seven (7) days of delivery of the Demand for Arbitration, then the AAA will appoint the arbitrator in accordance with the AAA Rules.

Arbitration Location and Procedure. Unless you and EcoExpert airbnb otherwise agree, the arbitration will be conducted in the county where you reside. If your claim does not exceed $10,000, then the arbitration will be conducted solely on the basis of documents you and EcoExpert airbnb submit to the arbitrator, unless you request a hearing or the arbitrator determines that a hearing is necessary. If your claim exceeds $10,000, your right to a hearing will be determined by the AAA Rules. Subject to the AAA Rules, the arbitrator will have the discretion to direct a reasonable exchange of information by the parties, consistent with the expedited nature of the arbitration.

Arbitrator’s Decision. The arbitrator will render an award within the time frame specified in the AAA Rules. The arbitrator’s decision will include the essential findings and conclusions upon which the arbitrator based the award. Judgment on the arbitration award may be entered in any court having jurisdiction thereof. The arbitrator’s award damages must be consistent with the terms of the “Disclaimers and Limitations of Liability” section above as to the types and the amounts of damages for which a party may be held liable. The arbitrator may award declaratory or injunctive relief only in favor of the claimant and only to the extent necessary to provide relief warranted by the claimant’s individual claim. If you prevail in arbitration you will be entitled to an award of attorneys’ fees and expenses, to the extent provided under applicable law. EcoExpert airbnb will not seek, and hereby waives all rights it may have under applicable law to recover, attorneys’ fees and expenses if it prevails in arbitration.

Arbitration Fees. Your responsibility to pay any AAA filing, administrative and arbitrator fees will be solely as set forth in the AAA Rules. However, if your claim for damages does not exceed $75,000, EcoExpert airbnb will pay all such fees unless the arbitrator finds that either the substance of your claim or the relief sought in your Demand for Arbitration was frivolous or was brought for an improper purpose (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)).

Changes. Notwithstanding the provisions of the “Modification or Termination of EcoExpert airbnb Host Guarantee Terms” section above, if EcoExpert airbnb changes this “Dispute Resolution” section after the date you first accepted these EcoExpert airbnb Host Guarantee Terms (or accepted any subsequent changes to these EcoExpert airbnb Host Guarantee Terms), you may reject any such change by sending us written notice (including by email to info@ecoexpert.gr) within 30 days of the date such change became effective, as indicated in the “Last Updated Date” above or in the date of EcoExpert airbnb’s email to you notifying you of such change. By rejecting any change, you are agreeing that you will arbitrate any Dispute between you and EcoExpert airbnb in accordance with the provisions of this “Dispute Resolution” section as of the date you first accepted these EcoExpert airbnb Host Guarantee Terms (or accepted any subsequent changes to these EcoExpert airbnb Host Guarantee Terms).

Waiver and Severability

The failure of EcoExpert airbnb to enforce any right or provision of these EcoExpert airbnb Host Guarantee Terms will not constitute a waiver of future enforcement of that right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of EcoExpert airbnb. Except as expressly set forth in these EcoExpert airbnb Host Guarantee Terms, the exercise by either party of any of its remedies under these EcoExpert airbnb Host Guarantee Terms will be without prejudice to its other remedies under these EcoExpert airbnb Host Guarantee Terms or otherwise. If for any reason an arbitrator or a court of competent jurisdiction finds any provision of these EcoExpert airbnb Host Guarantee Terms invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the other provisions of these EcoExpert airbnb Host Guarantee Terms will remain in full force and effect.

Controlling Law and Jurisdiction

These EcoExpert airbnb Host Guarantee Terms will be interpreted in accordance with Irish law. You and we agree to submit to the non-exclusive jurisdiction of the Irish courts for resolving any dispute between the parties. If EcoExpert airbnb wishes to enforce any of its rights against you, we may elect to do so in the Irish courts or in the courts of the jurisdiction in which you are resident.”

The Dispute Resolution clause shall be removed and is not applicable.

EcoExpert airbnb refers to  EcoExpert airbnb, Inc. if you reside in the USA, and to  EcoExpert airbnb Ireland if you reside outside of the USA.  EcoExpert airbnb Payments, Inc. is a subsidiary of  EcoExpert airbnb, Inc. that processes payments for guests and hosts residing in the USA;  EcoExpert airbnb Payments UK Ltd. similarly handles such payments for guests and hosts residing outside of the USA.  EcoExpert airbnb Payments, Inc. and  EcoExpert airbnb Payments UK Ltd. (collectively, “ EcoExpert airbnb Payments”) are responsible for processing your Personal Information in connection with payments services related to use of the  EcoExpert airbnb Platform.

This Privacy Policy is intended to inform you about how we treat Personal Information that we process about you. If you do not agree to any part of this Privacy Policy, then we cannot provide the Platform or Services to you, and you should stop accessing the Platform and deactivate your  EcoExpert airbnb Account.   1. DEFINITIONS

Where the definition of a term does not appear in this Privacy Policy (such as “Listing”, “Accommodation”, “Content,” “Services” etc.), it shall be given its definition as outlined in our Terms of Service.

Affiliates” means companies related by common ownership or control. They can be financial and non-financial companies.

Aggregated Information” means information about all of our users or specific groups or categories of users that we combine together so that it no longer identifies or references an individual user.

Data Controller” means  EcoExpert airbnb, the company responsible for the use and processing of Personal Information.

Third Parties” means companies or persons not related by common ownership or control (i.e. non-affiliates) or other unrelated individuals. Third Parties can be financial and non-financial companies, or persons other than you and  EcoExpert airbnb.

  1. WHAT TYPES OF INFORMATION DOES  ECOEXPERT AIRBNB GATHER ABOUT ITS USERS?
    1. Information that you give us

We receive, store and process information, including Personal Information, that you make available to us when accessing or using our Platform and Services. Examples include when you:

      • fill in any form on the Platform, such as when you register or update the details of your user account, or when you supply ID and other verification information;
      • access or use the Platform, such as to search for or post Accommodations, make or accept bookings, pay for Accommodations, book or pay for any associated services that may be available (such as but not limited to cleaning), post comments or reviews, or communicate with other users;
      • link your account on a Third-Party site (e.g. Facebook) to your  EcoExpert airbnb Account, in which case we will obtain the Personal Information that you have provided to the Third-Party site, to the extent allowed by your settings with the Third-Party site and authorized by you;
      • communicate with  EcoExpert airbnb; and
      • share information with another Member.
    1. Information we get from your use of our Platform

We also receive, store and process information, possibly including Personal Information, when you access or use our Platform and Services, including but not limited to:

      • Mobile Data

When you use certain features of the Platform, in particular our mobile applications we may receive, store and process different types of information about your location, including general information (e.g. IP address, zip code) and more specific information (e.g. GPS-based functionality on mobile devices used to access the Platform or specific features of the platform). If you access the Platform through a mobile device and you do not want your device to provide us with location-tracking information, you can disable the GPS or other location-tracking functions on your device, provided your device allows you to do this. See your device manufacturer’s instructions for further details.

      • Log Data

We may also receive, store and process Log Data, which is information that is automatically recorded by our servers whenever you access or use the Platform, regardless of whether you are registered with  EcoExpert airbnb or logged in to your  EcoExpert airbnb Account, such as your IP Address, the date and time you access or use the Platform, the hardware and software you are using, referring and exit pages and URLs, the number of clicks, device event information, pages viewed and the order of those pages, and the amount of time spent on particular pages.

      • Cookies and other Tracking Technologies

EcoExpert airbnb uses cookies and other similar technologies, such as mobile application and other device identifiers, on the Platform. We may also allow our business partners to use their cookies and other tracking technologies on the Platform. As a result, when you access or use the Platform, you will provide or make available certain information to us and to our business partners.

While you may disable the usage of cookies through your browser settings, we do not change our practices in response to a “Do Not Track” signal in the HTTP header from your browser or mobile application. We track your activities if you click on advertisements for  EcoExpert airbnb services on Third-Party platforms such as search engines and social networks, and may use analytics to track what you do in response to those advertisements.

We may, either directly or through Third Parties we engage to provide services to us, also continue to track your behavior on our own Platform for purposes of our own customer support, analytics, research, product development, fraud prevention, risk assessment, regulatory compliance, investigation, as well as to enable you to use and access the Platform and pay for your activities on the Platform. We may also, either directly or through Third-Parties we engage to provide services to us, track your behavior on our own Platform to market and advertise our services to you on the Platform and Third-Party websites. Third Parties that use cookies and other tracking technologies to deliver targeted advertisements on our Platform and/or Third-Party websites may offer you a way to prevent such targeted advertisements by opting-out at the websites of industry groups such as the Network Advertising Initiative and/or the Digital Advertising Alliance. You may also be able to control advertising cookies provided by publishers, for example Google’s Ad Preference Manager. Please note that even if you choose to opt-out of receiving targeted advertising, you may still receive advertising on or about the Platform – it just will not be tailored to your interests. In addition, if you disable cookies, you may lose some of the features and functionality of using our Platform, Application and Services, as cookies are necessary to track and enhance your use and access.

Third Parties may not collect information about users’ online activities on the Platform except as described in this policy and our Cookie Policy.

      • Third-Party social plugins

Our Platform may use social plugins which are provided and operated by Third-Parties, such as Facebook’s Like Button.

As a result of this, you may send to the Third-Party the information that you are viewing on a certain part of our Platform. If you are not logged into your account with the Third-Party, then the Third Party may not know your identity. If you are logged into your account with the Third Party, then the Third Party may be able to link information about your visit to our Platform to your account with them. Similarly, your interactions with the social plugin may be recorded by the Third Party.

Please refer to the Third Party’s privacy policy to find out more about its data practices, such as what data is collected about you and how the Third Party uses such data.

  1. HOW  ECOEXPERT AIRBNB USES AND PROCESSES THE INFORMATION THAT YOU PROVIDE OR MAKE AVAILABLE
    1. We use, store and process information about you for the following general purposes:
      • to enable you to access and use the Platform;
      • to enable you to communicate with other Members, including but not limited to by sending them messages or other information during the Booking process;
      • to operate, protect, improve and optimize the Platform,  EcoExpert airbnb’s business, and our users’ experience, such as to perform analytics, conduct research, personalize or otherwise customize your experience, and to provide customer service;
      • to help create and maintain a trusted and safer environment on the Platform and Services, such as detection and prevention of actual and potential fraud and other harmful activity, conducting investigations and risk assessments, enforcing our Terms and policies, verifying the address of your listings, verifying any identifications provided by you (including by comparing the photo on that identification to another photo you provide to us), and conducting checks against databases and information sources (such as but not limited to public government databases) for fraud detection and prevention, risk assessment and harm prevention purposes. In this regard, we may do any or all of the foregoing with or without further notifying you;
      • to send you service, support and administrative messages, reminders, technical notices, updates, security alerts, and information requested by you;
      • to send you marketing, advertising, and promotional messages and other information that may be of interest to you, including information about  EcoExpert airbnb, our services, or general promotions for partner campaigns and services. You can unsubscribe or opt-out from receiving these communications in your settings (in the “Account” section) when you login to your  EcoExpert airbnb Account;
      • if a Guest has an employment or consulting relationship with a company or other organization that participates in the  EcoExpert airbnb Business Travel Program, and that Guest has linked their  EcoExpert airbnb Account to that organization, to administer the  EcoExpert airbnb Business Travel Program;
      • to administer referral programs, rewards, surveys, sweepstakes, contests, or other promotional activities or events sponsored or managed by  EcoExpert airbnb or our Third Party business partners; and
      • to comply with our legal obligations, resolve any disputes that we may have with any of our users, and enforce our agreements with Third Parties.
    2. How  EcoExpert airbnb Uses and Processes User Communications

We may, either directly or through Third-Parties we engage to provide services to us, review, scan, or analyze your communications with other users exchanged via the Platform for fraud prevention, risk assessment, regulatory compliance, investigation, product development, research and customer support purposes. For example, as part of our fraud prevention efforts, the Platform may scan and analyze messages to mask contact information and references to other websites. This helps to prevent fraudulent actors from asking Guests to send them money outside of the Platform, such as by bank transfer or other money transfer methods. We may also scan, review or analyze messages for research and product development purposes to help make search, booking and user communications more efficient and effective, as well as to debug, improve and expand product offerings. We will not review, scan, or analyze your communications for sending Third-Party marketing messages to you. We will also not sell these reviews or analyses of communications to Third Parties. We will also use automated methods to carry out these reviews or analyses where reasonably possible. However, from time to time we may have to manually review some communications. By using the Platform, you consent that  EcoExpert airbnb, in its sole discretion, may, either directly or through Third-Parties we engage to provide services to us, review, scan, analyze, and store your communications, whether done manually or through automated means.

  1. WHEN  ECOEXPERT AIRBNB DISCLOSES OR SHARES YOUR PERSONAL INFORMATION, AND TO WHOM

IMPORTANT: When you use the Platform, your data may be sent to the United States and possibly other countries.

We may transfer, store, use and process your information, including any Personal Information, to countries outside of the European Economic Area (“EEA”) including the United States. Please note that laws vary from jurisdiction to jurisdiction, and so the privacy laws applicable to the places where your information is transferred to or stored, used or processed in, may be different from the privacy laws applicable to the place where you are resident.

Your Personal Information may be disclosed as follows:

    1. Parts of your public profile page that contain some Personal Information may be displayed in other parts of the Platform to other users for marketing purposes or if you post content in a community forum or other features on the Platform that are visible to the general public.
    2. Your public Listing page will always include some minimum information such as the city and neighborhood where the Accommodation is located, your listing description, your calendar availability, your public profile photo, your responsiveness in replying to Guests’ queries, and any additional information you share with other Members. Your public Listing page may also include aggregated demand information (such as number of page views over a period of time). Parts of your public Listing page may be displayed in other parts of the Platform to other Members and/or Third Party platforms for marketing purposes. The Platform may also display the Accommodation’s approximate geographic location on a map, such that a user can see the general area of the Accommodation.
    3. The Platform allows your public profile and public Listing pages to be included in search engines, in which case your public profile and public Listing pages will be indexed by search engines and may be published as search results. This option is enabled by default, and you may opt out of this feature by changing your settings on the Platform. If you change your settings or the information on your public profile or public Listing pages, Third-Party search engines may not update their databases quickly or at all. We do not control the practices of Third-Party search engines, and they may use caches containing outdated information, including any information indexed by the search engine before you change your settings or the information on your public profile or public Listing pages.
    4. When you submit a request to book an Accommodation, your full name, and the full name of any confirmed Guests staying with you, and other Personal Information you agree to pass through to the Host(s) will become visible to the Host(s) of any Listing you Book or request to Book. We may also disclose parts of your public profile; your public Wish List; other Member reviews of you; and any additional information you share with other Members. In addition, if you agree to be contacted by the Host(s) by phone before your request to Book is accepted, and the Host(s) decides to do so,  EcoExpert airbnb will call your phone number first, before connecting you with the Host(s). We will not share your phone number unless there is a confirmed booking; if there is a confirmed booking, your phone number will become visible to the Host(s)/Guest, who may call you directly.
    5. When your request to book an Accommodation is accepted by the Host(s) or when a Guest books your Accommodation, we will disclose some of your Personal Information to the Host(s) and any confirmed Guest(s). However, your billing and payout information will never be shared with another user. If a Guest books an Accommodation for a business trip, and the Guest is engaged or employed by a company or other organization that is enrolled in our Business Travel Program, we may disclose the name of the Host and the address and other Accommodation information to the Guest’s organization.
    6. When a Host accepts your request to book an Accommodation, the Host may elect to use Third-Party services available through the  EcoExpert airbnb platform to assist with managing the Accommodation, such as cleaning services and lock providers. The Host may use features on the  EcoExpert airbnb platform to share information about the Guest with that Third-Party service provider for the purposes of coordinating the stay or managing the Accommodation, including check-in and check-out dates, Guest name, Guest’s phone number, and the Guest’s anonymized email address.
    7. You may have an employment or consulting relationship with a company or other organization that participates in the  EcoExpert airbnb Business Travel Program. If your organization participates in our Business Travel Program, we may share with it information related to your bookings through the Business Travel Program. If you as a Guest have linked your  EcoExpert airbnb Account to your organization and indicate that a booking is for business purposes, we may disclose your booking information (which may include your Personal Information) to your organization. Typically this information will include your name, dates of the booking, number of guests, cost of the booking, and the address of the booking. In addition, if your organization has requested that we provide it with information in the event of a dispute, emergency or similar situation involving your bookings through the Business Travel Program, we may notify your organization of the situation and disclose to it any information, including your Personal Information, that we believe in good faith is necessary to safely and quickly resolve or address the situation. If your organization uses Third Party travel management and/or crisis management companies, we may also disclose your booking information, or information related to a dispute, emergency or similar situation involving you, to those Third Parties.
    8. When a Guest stays at your Accommodation or when you stay at a Host’s Accommodation, we may ask you to review the Guest, Host, or the Accommodation. If you choose to provide a review, your review may be public on the Platform. Likewise, another Member’s review of you as a Guest or Host may be public on the Platform.
    9. You may link your account on a Third-Party social networking site to your  EcoExpert airbnb Account. We refer to a person’s contacts on these Third-Party sites as “Friends”. When you create this linkage:
      • some of the information you provide to us from the linking of your accounts may be published on your  EcoExpert airbnb Account profile;
      • your activities on the Platform may be displayed to your Friends on the Platform and/or that Third-Party site;
      • a link to your public profile on that Third-arty social networking site may be included in your  EcoExpert airbnb public profile;
      • other  EcoExpert airbnb users may be able to see any common Friends that you may have with them, or that you are a Friend of their Friend if applicable;
      • other  EcoExpert airbnb users may be able to see any schools, hometowns or other groups you have in common with them as listed on your linked social networking site(s);
      • the information you provide to us from the linking of your accounts may be stored, processed and transmitted for fraud prevention and risk assessment purposes; and
      • the publication and display of information that you provide to  EcoExpert airbnb through this linkage is subject to your settings and authorizations on the Platform and the Third-Party site.
    10. We may distribute parts of the Platform (including your Listing) for display on sites operated by  EcoExpert airbnb’s business partners and affiliates, using technologies such as HTML widgets. If and when your Listings are displayed on a partner’s site, information from your public profile page may also be displayed.
    11.  EcoExpert airbnb may provide your Personal Information to its Affiliates, including  EcoExpert airbnb Payments, and their employees, to use and process your Personal Information in the same way and to the same extent that we are permitted to under this Privacy Policy. These related entities comply with the same obligations that we have to protect your Personal Information under this Privacy Policy.  EcoExpert airbnb Payments may share your Personal Information for (i) their everyday business purposes; (ii) to jointly market products or services to you with other financial Third Parties with whom  EcoExpert airbnb Payments has a formal agreement; and (iii) with respect to information about your transactions and experiences only, for their Affiliates’ everyday purposes. You can unsubscribe or opt-out from receiving marketing communications in your settings (in the “Account” section) when you login to your  EcoExpert airbnb account.
    12. We may also engage Third Parties, who may be located outside of the EEA, to provide services to us, including but not limited to technology services and services to help verify your identification, to help match the photo on your ID to other photos of yourself you send to us, to conduct checks against databases such as but not limited to public government databases (where legally allowed), to otherwise assist us with fraud prevention and risk assessment, to assist us with customer service, to serve targeted ads, and to facilitate the payments or reimbursements you request (such as Concur and American Express). We may provide Personal Information about you to these Third Parties, or give them access to this Personal Information, for the limited purpose of allowing them to provide these services. For example, if we hire Third Parties, where permitted by applicable law, to conduct checks against databases such as but not limited to public government databases, we may provide your Personal Information, such as your full name and date of birth, to the Third Parties for the limited purpose of allowing them to conduct such checks, including background or registered sex offender checks, on our behalf. We will ensure that such Third Parties have contractual obligations to protect this Personal Information and to not use it for unrelated purposes.
    13. For any jurisdiction in which we facilitate the Collection and Remittance of Taxes or Opt-in for Host Remittance of Taxes as described in the “Taxes” section of the Terms of Service, Hosts and Guests expressly grant us permission, without further notice, to store, transfer and disclose data and other information relating to them or to their transactions, bookings, Accommodations and Occupancy Taxes, including, but not limited to, personally identifiable information such as Host or Guest’s name, listing addresses, transaction dates and amounts, tax identification number(s), the amount of taxes received by Hosts from Guests, or allegedly due, contact information and similar information, to the relevant Tax Authority.
    14. You acknowledge, consent and agree that  EcoExpert airbnb may access, preserve and disclose your account information and Collective Content if required to do so by law or in a good faith belief that such access, preservation or disclosure is reasonably necessary (a) to respond to claims asserted against  EcoExpert airbnb; (b) to comply with legal process (for example, subpoenas and warrants); (c) to enforce and administer our agreements with users, such as the Terms of Service, the Payments Terms of Service, this Privacy Policy, and the Host Guarantee Terms and Conditions; (d) for fraud prevention, risk assessment, investigation, customer support, product development and de-bugging purposes; or (e) to protect the rights, property or personal safety of  EcoExpert airbnb, its users or members of the public.

We will use commercially reasonable efforts to notify users about law enforcement requests for their data unless:

      • providing notice is prohibited by the legal process itself, by court order we receive, or by applicable law; or
      • we believe that providing notice would (a) be futile, (b) be ineffective, or (c) would create a risk of injury or bodily harm to an individual or group, or (d) create or increase a risk of fraud upon  EcoExpert airbnb’s property, its Members, the Platform, Application, or Services (collectively, “Risk Scenarios”).

In instances where  EcoExpert airbnb complies with legal requests for user data without notice to the user for the reasons described above,  EcoExpert airbnb will use commercially reasonable efforts to notify that user about the request after the fact if we determine in good faith that we are no longer legally prohibited from doing so and that no Risk Scenarios apply.

    1. We may also publish, disclose and use Aggregated Information and non-personal information for industry and market analysis, demographic profiling, marketing and advertising, and other business purposes.
  1. STATE PRIVACY LAWS

For California & Vermont residents:  EcoExpert airbnb Payments will not share information it collects about you with Affiliates or Third Parties, except as required or permitted by your state’s law.

  1. BUSINESS TRANSFERS BY  ECOEXPERT AIRBNB

If  EcoExpert airbnb undertakes or is involved in any merger, acquisition, reorganization, sale of assets or bankruptcy or insolvency event, then we may sell, transfer or share some or all of our assets, including your Personal Information. In this event, we will notify you before your Personal Information is transferred and becomes subject to a different privacy policy.

  1. HOW TO ACCESS, CHANGE OR DELETE YOUR INFORMATION, OR CANCEL YOUR  ECOEXPERT AIRBNB ACCOUNT

You may review, update, correct or delete the Personal Information in your  EcoExpert airbnb Account. If you would like to correct your information or cancel your  EcoExpert airbnb Account entirely, you can do so by logging in to your  EcoExpert airbnb Account. Please also note that any reviews, forum postings and similar materials posted by you may continue to be publicly available on the Platform in association with your first name, even after your  EcoExpert airbnb Account is cancelled.

  1. SECURING YOUR PERSONAL INFORMATION

We are continuously implementing and updating administrative, technical, and physical security measures to help protect your Personal Information against unauthorized access, destruction or alteration. However, no method of transmission over the Internet, and no method of storing electronic information, can be 100% secure. So, we cannot guarantee the security of your transmissions to us and of your Personal Information that we store.

  1. YOUR PRIVACY WHEN YOU ACCESS THIRD-PARTY WEBSITES AND RESOURCES

The Platform will contain links to other websites not owned or controlled by  EcoExpert airbnb.  EcoExpert airbnb does not have any control over Third-Party websites. These other websites may place their own cookies, web beacons or other files on your device, or collect and solicit Personal Information from you. They will have their own rules about the collection, use and disclosure of Personal Information. We encourage you to read the terms of use and privacy policies of the other websites that you visit.

Some portions of the Platform implement Google Maps/Earth mapping services, including Google Maps API(s). Your use of Google Maps/Earth is subject to Google’s terms of use (located at www.google.com/intl/en_us/help/terms_maps.html) and Google’s privacy policy (located at www.google.com/privacy.html), as may be amended by Google from time to time.

  1. SPECIAL FEATURES AND PROGRAMS
    1. Referral service and requesting references

The Platform provides a referral service that allows you to invite your friends and contacts to use the Platform. The Platform also allows you to ask your friends and contacts to write a reference for you, to be published on your  EcoExpert airbnb profile.

We may integrate the Platform with third party sites such as Facebook, so that you can send invitation messages or requests for references via the third party site itself. These messages will be sent by the third party site, and  EcoExpert airbnb does not collect or retain the contact information that is used to send them.

You may also send invitation/request emails via the Platform itself, in which case we will ask you for the contact information to which to send your invitation/request. You can type in the email addresses or other contact information manually, or you can choose to import the contacts in your address book(s). In both cases, we may use and store this information for the sole purposes of allowing you to send your friends and contacts an invitation or request for a reference, and for fraud detection and prevention. With respect to referrals, we will also store the email addresses of your invitees to track if your friend joins  EcoExpert airbnb in response to your referral.

If you request us to import your contacts, we will collect, but not store, the username and password for the email account you wish to import your contacts from. We will use this information only for the purpose of importing your contacts.

    1. Affiliate Program

If you are allowed to join  EcoExpert airbnb’s Affiliate Program and you sign up for it, you will have to provide us with certain Personal Information to enable us to provide the Affiliate Program to you.

    1. Meetups

The Platform may allow registered account holders to organize, search for or participate in offline events (“Meetups”) in selected cities.

If you organize a Meetup or indicate that you will attend one, this information, together with some of your public information (such as your profile picture and public profile page) and any messages that you post about that Meetup, will be visible to users who browse the event. However,  EcoExpert airbnb will never disclose where you are staying to another meetup user.

  1. CHANGES TO THIS PRIVACY POLICY

We may change how we collect and then use Personal Information at any time and without prior notice, at our sole discretion. We may change this Privacy Policy at any time. If we make material changes to the Privacy Policy, we will notify you either by posting the changed Privacy Policy on the Platform or by sending an email to you. We will also update the “Last Updated” date at the top of this Privacy Policy. If we let you know of changes through an email communication, then the date on which we send the email will be deemed to be the date of your receipt of that email.

It’s important that you review the changed Privacy Policy. If you do not wish to agree to the changed Privacy Policy, then we will not be able to continue providing the Platform and Services to you, and your only option will be to stop accessing the Platform and Services and deactivate your  EcoExpert airbnb Account. EcoExpert airbnb uses “cookies” in conjunction with the Platform to obtain information. A cookie is a small data file that is transferred to your device (e.g. your phone or your computer) for record-keeping purposes. For example, a cookie could allow the Platform to recognize your browser, while another could store your preferences and other information.

Your browser may allow you to set how it handles cookies, such as declining all cookies or prompting you to decide whether to accept each cookie. But please note that some parts of the Platform may not work as intended or may not work at all without cookies.

    1.  EcoExpert airbnb cookies and Third Party cookies

EcoExpert airbnb may place our cookies on your device via the Platform. Accordingly, our Privacy Policy will apply to our treatment of the information we obtain via our cookies.

We may also allow our business partners to place cookies on your device. For example, we use Google Analytics for web analytics, and so Google may also set cookies on your device. As further explained below, Third Parties may also place cookies on your device for advertising purposes.

There are two types of cookies used on the Platform, namely “persistent cookies” and “session cookies”.

Session cookies will normally expire when you close your browser, while persistent cookies will remain on your device after you close your browser, and can be used again the next time you access the Platform.

    1. Other technologies

The Platform may also use other technologies with similar functionality to cookies, such as web beacons and tracking URLs to obtain Log Data about users. EcoExpert airbnb (hereinafter referred to as “ EcoExpert airbnb“, “we“, “us” or “our“) operates a platform and community marketplace that helps people form offline experiences and relationships directly with one another, where they can create, list, discover and book unique accommodations around the world, whether through our website or our mobile applications (“Platform“).  EcoExpert airbnb refers to  EcoExpert airbnb Inc. if you reside in the USA, and to  EcoExpert airbnb Ireland if you reside outside of the USA.

This Privacy Policy is intended to inform you about how we treat Personal Information that we process about you. If you do not agree to any part of this Privacy Policy, then we cannot provide the Platform or Services to you, and you should stop accessing the Platform and deactivate your  EcoExpert airbnb account. DEFINITIONS

Aggregated Information” means information about all of our users or specific groups or categories of users that we combine together so that it no longer identifies or references an individual user.

  1. Mobile Data

When you use certain features of the Platform, in particular our mobile applications we may receive, store and process different types of information about your location, including general information (e.g., IP address, zip code) and more specific information (e.g., GPS-based functionality on mobile devices used to access the Platform or specific features of the platform). If you access the Platform through a mobile device and you do not want your device to provide us with location-tracking information, you can disable the GPS or other location-tracking functions on your device, provided your device allows you to do this.   1. Log Data

We may also receive, store and process Log Data, which is information that is automatically recorded by our servers whenever you access or use the Platform, regardless of whether you are registered with  EcoExpert airbnb or logged in to your  EcoExpert airbnb account, such as your IP Address, the date and time you access or use the Platform, the hardware and software you are using, referring and exit pages and URLs, the number of clicks, pages viewed and the order of those pages, and the amount of time spent on particular pages.

HOW  ECOEXPERT AIRBNB USES AND PROCESSES THE INFORMATION THAT YOU PROVIDE OR MAKE AVAILABLE

We use, store and process Information about you for the following general purposes:

HOW  ECOEXPERT AIRBNB USES AND PROCESSES USER COMMUNICATIONS

We may, either directly or through third party companies and individuals we engage to provide services to us, review, scan, or analyze your communications with other users exchanged via the Platform for fraud prevention, risk assessment, regulatory compliance, investigation, product development, research and customer support purposes. For example, as part of our fraud prevention efforts, the Platform may scan and analyze messages to mask contact information and references to other websites. This helps to prevent fraudulent actors from asking Guests to send them money outside of the Platform, such as by bank transfer or other money transfer methods. We may also scan, review or analyze messages for research and product development purposes to help make search, booking and user communications more efficient and effective, as well as to debug, improve and expand product offerings. We will not review, scan, or analyze your communications for sending third party marketing messages to you. We will also not sell these reviews or analyses of communications to third parties. We will also use automated methods to carry out these reviews or analyses where reasonably possible. However, from time to time we may have to manually review some communications. By using the Platform, you consent that  EcoExpert airbnb, in its sole discretion, may, either directly or through third party companies and individuals we engage to provide services to us, review, scan, analyze, and store your communications, whether done manually or through automated means.

WHEN  ECOEXPERT AIRBNB DISCLOSES OR SHARES PERSONAL INFORMATION, AND TO WHOM

IMPORTANT: When you use the Platform, your data may be sent to the United States and possibly other countries

We may transfer, store, use and process your information, including any Personal Information, to countries outside of the European Economic Area (“EEA“) including the United States. Your Personal Information may be disclosed as follows:

 

  1. Parts of your public profile page that contain some Personal Information may be displayed in other parts of the Platform to other users for marketing purposes or to the extent necessary to operate and manage referral and rewards programs.

Your public Listing page will always include some minimum information such as the city and neighborhood where the Accommodation is located, your listing description, your calendar availability, your public profile photo and your responsiveness in replying to Guests’ queries. Your public Listing page may also include aggregated demand information (such as number of page views over a period of time). Parts of your public Listing page may be displayed in other parts of the Platform to other users for marketing purposes. The Platform may also display the Accommodation’s approximate geographic location on a map, such that a user can see the general area of the Accommodation.

 

  1. The Platform allows your public profile and public Listing pages to be included in search engines, in which case your public profile and public Listing pages will be indexed by search engines and may be published as search results. This option is enabled by default, and you may opt out of this feature by changing your settings on the Platform. If you change your settings or the information on your public profile or public Listing pages, third-party search engines may not update their databases quickly or at all. We do not control the practices of third-party search engines, and they may use caches containing outdated information, including any information indexed by the search engine before you change your settings or the information on your public profile or public Listing pages.

 

  1. When you submit a request to book an Accommodation, your full name will become visible to the Host. In addition, if you agree to be contacted by the Host by phone when submitting your request and the Host decides to do so,  EcoExpert airbnb will call your phone number first, before connecting you with the Host. We will not share your phone number unless there is a confirmed booking; if there is a confirmed booking, your phone number will become visible to the Host/Guest, who may call you directly.

 

  1. When your request to book an Accommodation is accepted by the Host or when you accept a Guest’s request to book your Accommodation, we will disclose some of your Personal Information to the Host or Guest. However, your billing and payout information will never be shared with another user.

 

  1. When a Guest stays at your Accommodation or when you stay at a Host’s Accommodation, we will ask you to review the Guest or the Accommodation. If you choose to provide a review, your review may be public on the Platform.

 

  1. You may link your account on a third party social networking site to your  EcoExpert airbnb account. We refer to a person’s contacts on these third party sites as “Friends”. When you create this linkage:

 

    • some of the information you provide to us from the linking of your accounts may be published on your  EcoExpert airbnb account profile;

 

    • your activities on the Platform may be displayed to your Friends on the Platform and/or that third party site;

 

    • other  EcoExpert airbnb users may be able to see any common Friends that you may have with them, or that you are a Friend of their Friend if applicable;

 

    • other  EcoExpert airbnb users may be able to see any schools, hometowns or other groups you have in common with them as listed on your linked social networking site(s); and

 

    • the information you provide to us from the linking of your accounts may be stored, processed and transmitted for fraud prevention and risk assessment purposes.

 
The publication and display of information that you provide to  EcoExpert airbnb through this linkage is subject to your settings and authorizations on the Platform and the third party site.

 

  1. We may distribute parts of the Platform (including your Listing) for display on sites operated by  EcoExpert airbnb’s business partners and affiliates, using technologies such as HTML widgets. If and when your Listings are displayed on a partner’s site, information from your public profile page may also be displayed.

 

  1. We may allow our related entities such as our subsidiaries, and their employees, to use and process your Personal Information in the same way and to the same extent that we are permitted to under this Privacy Policy. These related entities comply with the same obligations that we have to protect your Personal Information under this Privacy Policy.

 

  1. We may also engage third party companies and individuals, who may be located outside of the EEA, to provide services to us, including but not limited to technology services and services to help verify your identification, to conduct checks against databases such as public government databases (where legally allowed), to otherwise assist us with fraud prevention and risk assessment, to assist us with customer service, and to facilitate the payments or reimbursements you request (such as Concur and American Express). We may provide Personal Information about you to these third parties, or give them access to this Personal Information, for the limited purpose of allowing them to provide these services. We will ensure that such third parties have contractual obligations to protect this Personal Information and to not use it for unrelated purposes.

For any jurisdiction in which we facilitate the Collection and Remittance of Taxes or Opt-in for Host Remittance of Taxes as described in the “Taxes” section of the Terms of Service, Hosts and Guests expressly grant us permission, without further notice, to store, transfer and disclose data and other information relating to them or to their Transactions, Bookings, Accommodations and Occupancy Taxes, including, but not limited to, personally identifiable information such as Host or Guest’s name, listing addresses, transaction dates and amounts, tax identification number(s), the amount of taxes received by Hosts from Guests, or allegedly due, contact information and similar information, to the relevant Tax Authority.

 

  1. You acknowledge, consent and agree that  EcoExpert airbnb may access, preserve and disclose your account information and Collective Content if required to do so by law or in a good faith belief that such access, preservation or disclosure is reasonably necessary to (a) respond to claims asserted against  EcoExpert airbnb; (b) to comply with legal process (for example, subpoenas and warrants); (c) to enforce and administer our agreements with users, such as the Terms of Service, (http://www. EcoExpert airbnb.com/terms), this Privacy Policy, and the Host Guarantee Terms and Conditions (http://www. EcoExpert airbnb.com/terms/host_guarantee); (d) for fraud prevention, risk assessment, investigation, customer support, product development and de-bugging purposes; or (e) to protect the rights, property or personal safety of  EcoExpert airbnb, its users or members of the public. We will use commercially reasonable efforts to notify users about law enforcement requests for their data unless:

 

    • providing notice is prohibited by the legal process itself, by court order we receive, or by applicable law; or

 

    • based on information supplied by law enforcement, we, in our sole discretion, believe: (a) that providing notice could create a risk of injury or death to an individual or group of individuals, (b) that the case involves potential harm to minors, or (c) that harm or fraud could be directed to  EcoExpert airbnb, its Members, the Platform, or Services.

BUSINESS TRANSFERS BY  ECOEXPERT AIRBNB

If  EcoExpert airbnb undertakes or is involved in any merger, acquisition, reorganization, sale of assets or bankruptcy or insolvency event, then we may sell, transfer or share some or all of our assets, including your Personal Information. In this event, we will notify you before your Personal Information is transferred and becomes subject to a different privacy policy.

HOW TO CHANGE OR DELETE YOUR INFORMATION, OR CANCEL YOUR  ECOEXPERT AIRBNB ACCOUNT

If you would like to correct your information or cancel your  EcoExpert airbnb account entirely, you can do so by logging in to your account. Please also note that any reviews, forum postings and similar materials posted by you may continue to be publicly available on the Platform in association with your first name, even after your  EcoExpert airbnb account is cancelled.

SECURING YOUR PERSONAL INFORMATION

We are continuously implementing and updating administrative, technical, and physical security measures to help protect your Personal Information against unauthorized access, destruction or alteration. However, no method of transmission over the Internet, and no method of storing electronic information, can be 100% secure. So, we cannot guarantee the absolute security of your transmissions to us and of your Personal Information that we store.

YOUR PRIVACY WHEN YOU ACCESS THIRD-PARTY WEBSITES AND RESOURCES

The Platform will contain links to other websites not owned or controlled by  EcoExpert airbnb.  EcoExpert airbnb does not have any control over third party websites. These other websites may place their own cookies, web beacons or other files on your device, or collect and solicit Personal Information from you. They will have their own rules about the collection, use and disclosure of Personal Information. We encourage you to read the terms of use and privacy policies of the other websites that you visit.

Some portions of the Platform implement Google Maps/Earth mapping services, including Google Maps API(s). Your use of Google Maps/Earth is subject to Google’s terms of use (located at www.google.com/intl/en_us/help/terms_maps.html) and Google’s privacy policy (located at http://www.google.com/privacy.html), as may be amended by Google from time to time.

SPECIAL FEATURES AND PROGRAMS

Referral service and requesting references

The Platform provides a referral service that allows you to invite your friends and contacts to use the Platform. The Platform also allows you to ask your friends and contacts to write a reference for you, to be published on your  EcoExpert airbnb profile.

We may integrate the Platform with third party sites such as Facebook, so that you can send invitation messages or requests for references via the third party site itself. These messages will be sent by the third party site, and  EcoExpert airbnb does not collect or retain the contact information that is used to send them.

You may also send invitation/request emails via the Platform itself, in which case we will ask you for the contact information to which to send your invitation/request. You can type in the email addresses or other contact information manually, or you can choose to import the contacts in your address book(s). In both cases, we may use and store this information for the sole purposes of allowing you to send your friends and contacts an invitation or request for a reference, and for fraud detection and prevention. With respect to referrals, we will also store the email addresses of your invitees to track if your friend joins  EcoExpert airbnb in response to your referral.

If you request us to import your contacts, we will collect, but not store, the username and password for the email account you wish to import your contacts from. We will use this information only for the purpose of importing your contacts.

Affiliate Program

If you are allowed to join  EcoExpert airbnb’s Affiliate Program (see www. EcoExpert airbnb.com/affiliates) and you sign up for it, you will have to provide us with certain Personal Information to enable us to provide the Affiliate Program to you.

Meetups

The Platform may allow registered account holders to organize, search for or participate in offline events (“Meetups“) in selected cities.

If you organize a Meetup or indicate that you will attend one, this information, together with some of your public information (such as your profile picture and public profile page) and any messages that you post about that Meetup, will be visible to users who browse the event. However,  EcoExpert airbnb will never disclose where you are staying to another meetup user.

Groups

The Platform may allow registered account holders to participate in online discussion forums (“Group(s)“) in selected cities.

If you join a Group, then your membership in the Group as well as some of your public information (such as your profile picture and public profile page) will be visible to users who browse the Group. If you publish postings in a Group, then your postings will be visible to such users as well. The ability to browse the Group will depend on the Group settings, and it may or may not be limited to members of that Group.

CHANGES TO THIS PRIVACY POLICY

We may change how we collect and then use Personal Information at any time and without prior notice, at our sole discretion. We may change this Privacy Policy at any time. If we make material changes to the Privacy Policy, we will notify you either by posting the changed Privacy Policy on the Platform or by sending an email to you. We will also update the “Last Updated Date” at the top of this Privacy Policy.
